A Federal High court sitting in Abuja has strike out a case brought before it by Frank Arimosoghene Ossai of All Progressives Grand Alliance, APGA, against the submission of Daniel Omeco Ekorhi as the candidate of the party for February 25th, 2023, election to represent Ughelli North/ Ughelli South/ Udu Federal Constituency.
Ossai had on August 5, 2022, approached the court in Abuja with suit no: FHC/ABJ/CS/1285/2022 to interpret the section of the constitution to challenge the submission of Daniel Omeco Ekorhi name as the candidate of APGA.
In his submission, Ossai prayed the court to declare him as the candidate for the forthcoming general election under the All Progressives Grand Alliance, APGA.
The court in its ruling by Justice Emeka Nwite on January 20, 2023 which also had Destiny Akpovoka as a Co Defendant, ruled that the applicant filed his process outside the 14 days that is provided by the 1999 constitution of the federal Republic of Nigeria as amended.
It would be recalled that the Federal High in Warri, Delta state had earlier struck out a Counter defense and a motion for extension of time brought before it by Akpovoka Efeni Destiny in a suit no: FHC/WR/CS/98/2022 against Daniel Omeco Ekorhi on his name submission and the removal of his name as candidate of the party.
Reacting to the Judgement Olorogun Omeco Daniel Ekorhi dedicates both victories to God as he called on his party brothers to join hands with him and wrestle power from the party in government.
