A Delta State High Court 1 sitting in Ughelli, presided by Hon Justice A. A Onojovwo, on Thursday December 14, 2023, granted an interim injunction, retraining Monday Otobrise, Idiovwan College, Efekoha Simeon, Pa. Uweghrepha Akpoyerabor, Aginja Edafeudubre, Lawrence Okpako, Oruma John and Kpuwhara Friday and others of Oviri-Ogor community of Ughelli North from conducting any elections or Bye-bye election into the executive offices of Oviri-Ogor community on any date pending the hearing and determination of the motion notice.
Messes Godstime Assin, Akporuku Gabriel, Odudu Samuel, Dele Igoru, Evelyn Ikutegbe (Mrs) and John Akpoyerabor for themselves and on behalf of Elders, Leaders and Concerned Members of Oviri-Ogor community of Ughelli North Local Government Area of Delta State, except the defendants had approach the court as Claimants/ Applicants in suit No: UHC/265/2023 to file Enrollment of an Order in restraining Monday Otobrise and others from conducting any election or swearing in into any offices of Oviri-Ogor Community executive.
According to the suit, AN ORDER OF INTERIM INJUNCTION RESTRAINING THE DEFENDANTS HEREIN, THEIR AGENTS, PRIVIES, ASSIGNS, WORKERS AND/OR PERSONS CLAIMING THROUGH THEM FROM CONDUCTING ANY ELECTIONS BY WHATEVER NAME CALLED AND/OR BYE-ELECTION INTO THE EXECUTIVE OFFICES OF OVIRI-OGOR COMMUNITY ON ANY DATE WHATSOEVER PENDING THE HEARING AND DETERMINATION OF THE MOTION ON NOTICEAN ORDER OF INTERIM INJUNCTION RESTRAINING THE DEFENDANTS HEREIN, THEIR AGENTS, PRIVIES, ASSIGNS, WORKERS AND/OR PERSONS CLAIMING THROUGH THEM FROM AMETIDING/REVIEWING AND/OR ALTERING IN ANY MANNER WHATSOEVER AND HOWSOEVER THE 2015 CONSTITUTION OF THE OVIRI-OGOR COMMUNITY AND/OR PROMULGATING ANY OTHER CONSTITUTION HOV SOEVER AND/OR WHATSOEVER AND/OR DOING ANYTHING WHATSOEVER AND HOWSOEVER WITH THE INTENTION AND/OR EFFECT OF OVER REACHING THE SUBJECT MATTER OF THIS SUIT PENDING THE HEARING AND DETERMINATION OF THE MOTION ON NOTICE
And for such further order or orders as this Honourable Court may deem fit and proper to make in the circumstances.
